ORDER This 28th day of October, 1992, upon consideration of: (1) the application of respondent below-appellant for acceptance of an interlocutory appeal from an order of the Court of Chancery dated September 22, 1992, pursuant to Supreme Court Rule 42; (2) appellant's motion under Rule 25(d) for expedited scheduling; (3) appellees' responses in opposition to the application; and (4) the Court of Chancery's Order of October 21, 1992 denying certification of its order for an interlocutory appeal and the Court having concluded that the appeal does not meet the criteria of Rule 42, NOW, THEREFORE, IT IS ORDERED that the petition for interlocutory appeal is REFUSED and the appellant's motion under Rule 25(d) is thereby rendered MOOT.
